Idaho has NO legal cannabis - no medical, no recreational, no CBD (if >0% THC). Any possession is criminal. Constitutional amendment bans legalization.

Idaho has the strictest cannabis laws in the US. NO medical program. NO decriminalization. CBD products must contain 0% THC to be legal. In 2025, the legislature passed HJR 4, a proposed constitutional amendment (on the November 2026 ballot, not yet voted on) that would give the legislature exclusive authority over any marijuana legalization, blocking citizen ballot initiatives. Also effective July 1, 2025, HB 7 imposes a mandatory minimum $300 fine for possession under 3 oz. Possession under 3oz is misdemeanor (up to 1 year, $1000 fine). Over 3oz or any sale is felony. Concentrated cannabis (hash, oils) treated more severely. Idaho Code §37-2732.
