Montana legalized recreational cannabis in 2020 (I-190), effective January 1, 2021. Adults 21+ may possess up to 1 oz and cultivate up to 4 mature plants (4 seedlings) at home. Retail sales operational statewide. PUBLIC CONSUMPTION PROHIBITED. Local jurisdictions may opt out of retail sales. DUI: Per se limit - 5 ng/mL or more Delta-9 THC in blood is DUI (MCA §61-8-1002); impairment charges possible below that level. MCA §16-12-101.
