Vermont E-Bike Classes, Age and Path Access
Vermont defines class 1, 2 and 3 electric bicycles and governs them as bicycles, exempt from registration, licensing and insurance; they may be ridden where bicycles are allowed including highways, bike lanes and multi-use paths, a municipality or state agency may bar class 1 or class 2 from a path only after notice, a public hearing and a safety finding but may bar class 3 outright, natural-surface non-motorised trails are regulated separately by the authority with jurisdiction, and no one under 16 may operate a class 3 (23 V.S.A. 1136a; definitions at 23 V.S.A. 4(46)).
Vermont governs electric bicycles as bicycles (23 V.S.A. §1136a(a)), with class definitions at 23 V.S.A. §4(46). E-bikes and their operators are exempt from motor-vehicle registration, inspection and certificate-of-title requirements, operator's-license requirements, financial-responsibility requirements, and the requirements applicable to all-terrain vehicles (§1136a(b)) — no license, registration or insurance is required. An e-bike may be ridden in places where bicycles are allowed, including highways, bicycle lanes, and bicycle or multiuse paths (§1136a(e)(1)). Path restrictions are asymmetric: a municipality, local authority or State agency with jurisdiction over a bicycle or multiuse path may prohibit Class 1 or Class 2 e-bikes on that path only following notice and a public hearing, and only on a finding that the restriction is needed for safety or for compliance with other legal obligations (§1136a(e)(2)); it may prohibit Class 3 e-bikes on such a path without those steps (§1136a(e)(3)). Trails specifically designated as nonmotorized with a natural-surface tread are outside those path rules — the authority with jurisdiction over such a trail may regulate e-bike use on it (§1136a(e)(4)). No one under 16 may operate a Class 3 e-bike, though they may ride as a passenger on a Class 3 designed to accommodate passengers (§1136a(f)). A Class 3 must be equipped with a speedometer displaying miles per hour (§1136a(d)). Vermont's e-bike statute contains no helmet requirement.
