West Virginia E-Bike Laws
West Virginia uses the three-class e-bike system (W. Va. Code 17C-1-70: two- or three-wheeled vehicle with fully operable pedals and a motor under 750 watts; Class 1 pedal-assist to 20 mph, Class 2 throttle to 20 mph, Class 3 pedal-assist to 28 mph) and exempts e-bikes from registration, title, driver's licence and financial-responsibility requirements; Class 1 and Class 2 have the same rights and duties as ordinary bicycles wherever bicycles are allowed, a Class 3 may not be operated on a bicycle path, multiuse trail or single-use trail unless it is within a highway or roadway or the authority with jurisdiction expressly permits it, e-bikes get no access beyond what ordinary bicycles have, any operator or passenger under 15 must wear a fitted bicycle helmet, and operating any class under the influence of alcohol or controlled substances is prohibited (W. Va. Code 17C-11-8).
West Virginia uses the three-class e-bike system, adopted in 2020 (Enrolled Committee Substitute for S.B. 660) and amended in 2023 (H.B. 2062), codified at W. Va. Code 17C-1-70 and 17C-11-8. An electric bicycle is a two- or three-wheeled vehicle with fully operable pedals and an electric motor of fewer than 750 watts: Class 1 pedal-assist to 20 mph, Class 2 throttle to 20 mph, Class 3 pedal-assist to 28 mph (17C-1-70). E-bikes are exempt from registration, title, driver's-license and financial-responsibility requirements (17C-11-8(b)). Class 1 and Class 2 e-bikes have the same rights and duties as traditional bicycles on roads and trails where bicycle use is allowed; a Class 3 may not be operated on a bicycle path, multiuse trail or single-use trail unless it is within a highway or roadway, or the municipality, local authority or state agency with jurisdiction expressly permits it; e-bikes get no special access beyond what ordinary bicycles are allowed (17C-11-8(h)). There is no minimum operating age for any class, but any operator or passenger under 15 years of age must wear a properly fitted and fastened bicycle helmet (17C-11-8(i)(2)). A Class 3 must be equipped with a speedometer (17C-11-8(f)), and operating any class under the influence of alcohol or controlled substances is prohibited (17C-11-8(j)). Private property owners may restrict or allow e-bike operation on their land.
