OPEN CONTAINER: Illegal for the driver to drink while operating the vehicle (VA Code § 18.2-323.1); Virginia law does not prohibit passengers from possessing an open container. DUI: 0.08% BAC. Virginia Beach boardwalk: no alcohol. VA Code §4.1-100.
