Guam Fireworks Laws
FIREWORKS: Generally prohibited. Fireworks are permitted only when consigned to the Guam or federal government and discharged under direct government supervision. Guam law narrowly excludes qualifying toy-pistol caps and similar small-explosive party favors from the definition of "fireworks," as determined by the Fire Chief.
CURRENT RULE
10 GCA §58109 generally prohibits fireworks in Guam unless they are consigned to the Guam or federal government and discharged under direct official supervision. Government-consigned fireworks discharged under the supervision of Guam or federal authorities are the only permitted use.
EXCLUSIONS
Section 58110 excludes toy-pistol caps and party favors containing comparably small amounts of explosives, with the Fire Chief determining whether an item qualifies.
PENALTIES
Violation of any provision of Chapter 58 is a civil violation (10 GCA §58111):
- First offense: up to $100
- Second offense of the same fire code provision within 12 months: up to $400, but not less than $100
- Third offense of the same fire code provision within 12 months: not less than $1,000
- Fourth offense of the same fire code provision within 12 months: punishable as a misdemeanor, and the business license is suspended for up to 1 year or until the violation has been cured
HISTORY
P.L. 37-047 created a regulated consumer-fireworks framework on November 10, 2023, but P.L. 38-012 became law without signature on June 17, 2025, amended §§58109–58110, and repealed Chapter 58B. Chapter 58B is repealed and is not authority for private consumer-fireworks permits today.
